Compliance requirements
The bidder must confirm that it and its representatives are not subject to exclusion grounds relating to final convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and human trafficking. The bidder must also confirm that it has fulfilled its tax and social security contribution obligations, has not been convicted of enabling unlawful employment of a foreign national, and is not subject to an international sanction that would make the contract unlawful. The bidder must confirm that it will not use a subcontractor who would have to be replaced under the applicable procurement rules. Where an exclusion ground applies, the tender documents describe the possibility of submitting evidence of measures taken to restore the bidder’s reliability, where permitted.
Qualification criteria and exclusion grounds
The bidder must be entered in the relevant business register in accordance with the law of its country of establishment and provide registration details or evidence if requested. Its average annual turnover for 1 January 2023 to 31 December 2025 must be at least EUR 75,000. The bid must follow the buyer’s specified price structure, comply with the tender documents and not be conditional. For joint bids, the bidders must appoint an authorised representative and include the power of attorney. The bidder must confirm that the furniture uses only legally sourced timber and provide proof of origin upon delivery; declare REACH Candidate List substances present above 0.1% by weight and provide evidence of their presence or absence upon delivery; supply furniture that can be dismantled and repaired with hand tools, with dismantling and repair instructions; provide a warranty of at least two years and ensure spare parts or functionally equivalent components are available for at least two years after delivery. A list of packaging materials and an explanation of their recyclability, renewable sourcing or reusability and ease of sorting is a recommended additional criterion.
