Compliance requirements
The bidder must confirm that neither the bidder nor its relevant management, supervisory or authorised representatives has been convicted of offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, illegal employment of foreign nationals, unlawful use of child labour or human trafficking. The bidder must also have no tax, duty or environmental charge arrears. The contracting authority may exclude a bidder that has seriously or repeatedly breached an earlier public contract, or that has submitted false information or failed to provide required information or documents. Participation is not permitted for companies established or resident in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
During the 60 months preceding the commencement of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of this procurement. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the details of the other contracting party and its representative's contact information, and the procurement reference numbers for public contracts. At the contracting authority's request, evidence of proper performance must be provided unless the authority can obtain it from public or private databases without significant expense.
The team must include a person with valid switching authorisations for work-related switching operations in the 0.22–20 kV electricity network. For low-voltage-only works, at least low-voltage switching authorisation is required; in other cases, both low- and medium-voltage switching authorisations are required where medium-voltage switching is needed. The person must be registered in Elektrilevi's partner portal before the tender submission deadline.
The bidder must also have a person responsible for the work operation, registered in Elektrilevi's partner portal before the tender submission deadline, and a person leading the electrical works with valid A competence and/or a qualification of at least level 6 under the Estonian Professional Qualifications Act. The latter must hold the relevant evidence when the tender is submitted and must be registered in the partner portal before the deadline.
The tender must comply with all procurement documents and may not contain additional or conditional terms. The price must be submitted using the required price table, with every unit-price field completed. The bidder must provide the names, positions and contact details of the contract signatory or signatories and a contact person for contract performance; a power of attorney must be included if signing authority does not arise from the articles of association. The bidder must also confirm that the materials, equipment and goods used, including components, are not produced in or originating from Russia or Belarus; origin certificates may be requested.
