Compliance requirements
The bidder must declare whether it or its management, supervisory or representative persons have relevant final convictions within the past five years, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. Declarations also cover unpaid taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation or similar situations; suspension of business; serious professional misconduct; anti-competitive agreements; conflicts of interest; involvement in preparing this procurement that could distort competition; serious or repeated breaches of previous contracts resulting in early termination, damages or comparable sanctions; false or misleading information, withholding information, failure to provide requested documents, or improper attempts to influence the procurement or obtain confidential information. National grounds also cover convictions for tax offences, enabling a person without lawful residence status to work, and contracts that would breach international or national sanctions. The tax-debt information explains that debts below EUR 100, excluding interest not formally assessed, or debts subject to an instalment arrangement do not result in a tax-debt certificate being issued. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
