Compliance requirements

The bidder must not be subject to exclusion grounds related to final criminal convictions, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations. Other exclusion grounds concern environmental, social and labour-law violations, bankruptcy or insolvency proceedings, agreements with creditors, comparable insolvency situations, liquidation or administration of assets by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious or repeated breaches of earlier public contracts, false or misleading information, failure to submit required information or documents, and attempts to obtain confidential information or improperly influence the contracting authority. The bidder must also comply with the national exclusion grounds concerning the employment of unlawfully residing foreign nationals, international sanctions, tax offences, local tax debt where applicable, and any participation restrictions based on the bidder’s place of establishment. For first-tier subcontractors, the contracting authority checks exclusion grounds during contract performance; those subcontractors must submit a European Single Procurement Document. Where an exclusion ground exists, the bidder may provide evidence of remedial measures restoring its reliability if such possibility applies.

Qualification criteria and exclusion grounds

The bidder’s total net turnover must have been at least EUR 250,000 in each of the last three financial years completed before the procurement was initiated. The bidder must provide the turnover data in the European Single Procurement Document and, if the information is not publicly available, submit an extract from the annual report or another appropriate piece of evidence. If the bidder relies on another entity’s financial capacity, a separate European Single Procurement Document must also be submitted for that entity. By the contract award date, the bidder must hold the required registrations or permits for general construction and for the conservation and restoration of monuments and buildings located at World Heritage sites, or equivalent authorisation under the law of its country of establishment. The bidder must involve a project manager directly in contract performance. The project manager must have managed at least two conservation or restoration works on cultural monuments, including general construction works, as the contractor’s project manager during the five years preceding the procurement. The project manager must hold either a level 6 construction engineer qualification specialising in building construction with competence in managing construction activities, or a level 6 construction manager qualification specialising in general construction with the specified competences in stone and concrete, timber and steel structures, demolition and façade works, or an equivalent qualification. The bid must include the project manager’s CV using the required form and evidence or data proving the qualification; if the project manager is not employed by the bidder, the CV must be signed to confirm consent to participate. The bid must be unconditional and comply with all procurement documents. Joint bidders must submit a power of attorney for their authorised representative. Equivalent products or solutions may be offered, but their equivalence must be explained and supported with evidence using the required equivalence table. The bid must include the completed price table, all unit prices and total prices in euros, both excluding and including VAT, with two decimal places. Every line of the price table must be completed without amendments or added conditions; prices must include all costs necessary for proper performance, and negative prices are not permitted. The bidder must also submit the required confirmations concerning subcontractors, sanctions, confidentiality of business secrets and direct participation of the project manager.
