Compliance requirements
The bidder must confirm that neither the bidder nor its board members, procurators or other persons with authority to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is allowed. Where relevant, the ESPD requires the date of conviction, the reason, the convicted person, the duration of exclusion and any electronically available evidence or references.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise selection, suitability or compliance criteria; these must be checked in the tender documents. The compliance conditions nevertheless require the bid to comply with the procurement documents and, where necessary, to explain equivalence and attach supporting evidence. If the technical requirements refer to a standard, trademark, type, origin, production method or test report, this must be read as including the words “or equivalent”. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. In the case of a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached.
