Compliance requirements
A bidder may be excluded for relevant final convictions of the bidder or its representatives within the last five years, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and unlawful child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an agreement with creditors, comparable proceedings, administration of assets by a liquidator or suspension of business; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; involvement in preparing the procurement where an resulting competitive advantage cannot otherwise be addressed; significant or repeated breaches of previous contracts resulting in early termination, damages or comparable sanctions; and false or misleading information, withholding information, failure to provide requested supporting documents, or improper attempts to obtain confidential information or influence the procurement.
National grounds also cover enabling a foreign national to work unlawfully or in breach of applicable employment conditions, including payment below the statutory rate; being subject to an international or Estonian government sanction that would make contract award unlawful; local tax debt in the contracting authority’s location; and convictions for tax offences. The exclusion ground for tax and social-contribution arrears has a stated threshold of EUR 0. In Estonia, however, a tax-debt certificate is not issued for debts below EUR 100 (excluding interest not determined by an administrative act) or where payment has been rescheduled. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must be able to provide a team covering eight roles: modelling specialist, GIS specialist, project manager, analyst, developer, architect, UX/UI designer and tester. One person may fill no more than two roles. The qualifications and experience of the specialists in each role must be demonstrated in a CV using Form 1:
- The modelling specialist must have a higher education degree in hydrology, geography, environmental sciences, environmental engineering, water management or another field related to the contract, and at least 12 months’ experience modelling flood or hydrological data during the 36 months preceding the start of the procurement.
- The GIS specialist must have a higher education degree in geography, information technology or another field related to the contract, and at least 12 months’ experience developing or implementing a spatial-data-based application during the preceding 36 months.
- The project manager must have a higher education degree and at least 12 months’ experience managing an information-system or software-development project during the preceding 36 months.
- The analyst must have a higher education degree in information technology, economics, management or another field related to the contract, and at least 12 months’ experience analysing requirements, business processes or functionality for an information system or software solution during the preceding 36 months.
- The developer must have a higher education degree in information technology, computer science, software engineering or another IT-related field, or at least three years of software-development experience; in either case, at least 12 months’ experience developing a web application, information system or other software solution during the preceding 36 months is required.
- The architect must have a higher education degree in information technology, computer science, software engineering or another IT-related field, and at least 12 months’ experience designing the architecture of an information system or software solution during the preceding 36 months.
- The UX/UI designer must have a higher education degree in design, information technology, multimedia, interaction design or another field related to the duties, or at least three years of UX/UI design experience; in either case, at least 12 months’ experience designing the user experience or user interface of a web application or information system during the preceding 36 months is required.
- The tester must have a higher education degree in information technology, computer science or another field related to the duties, or at least three years of software-testing experience; in either case, at least 12 months’ experience testing an information system, web application or other software solution during the preceding 36 months is required.
The bid must meet the tender documents’ technical specification and remain valid for at least 90 days. It must confirm that the bidder holds the intellectual property rights needed to perform the contract and related orders. Conditional bids are not permitted. A bidder signing through someone other than its legal representative must provide authorisation. Joint bidders must appoint an authorised representative and confirm their joint and several responsibility for contract performance; a power of attorney is required. The bid must identify any information claimed as a trade secret and explain the basis for that designation. Businesses established or located in Russia or Belarus may not participate. First-tier subcontractors will be checked during contract performance and must submit a European Single Procurement Document.
