Compliance requirements
Mandatory exclusion grounds include convictions of the bidder or relevant representatives for participation in a criminal organisation, breach of duty of honesty, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the unlawful employment of foreign nationals or paying below the statutory wage rate; unlawful use of child labour or trafficking in human beings; outstanding state tax, payment or environmental-charge debts, or tax or social-security arrears under the law of the bidder’s country of establishment; and being subject to an international sanction where contract award would breach that sanction.
The contracting authority may also exclude a bidder for breaches of environmental, social or labour-law obligations; insolvency, liquidation or comparable proceedings; serious professional misconduct; anti-competitive agreements or coordinated conduct; an unresolvable conflict of interest; involvement of a person connected with the preparation of the procurement where this creates an unavoidable competitive advantage; significant or repeated breaches of previous public contracts; false or misleading information or failure to submit requested documents; attempts to improperly influence the contracting authority or obtain confidential information; convictions for tax offences; or lack of the legal right to submit a tender. The bidder must confirm that none of the mandatory or voluntary exclusion grounds applies. Businesses established in the Russian Federation or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 350,000 in each of the last three completed financial years. The bidder must submit extracts from the financial statements for those years showing the net turnover, unless the information is publicly available to the contracting authority from a register. If the bidder’s financial year does not coincide with the calendar year, the requirement applies to the three most recently completed financial years. At least six months must have passed since the end of the most recently completed financial year by the tender submission date.
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement. At least one of these contracts must have had a value of at least EUR 80,000 excluding VAT. The bidder must submit a list of the contracts, including the performance periods, details and contact information of the other contracting parties, and procurement reference numbers where applicable. Evidence of proper performance must be provided upon request unless the contracting authority can obtain it from public or private databases without disproportionate cost.
The bidder must have a person with valid switching rights for work-related operations in the 0.22–20 kV electricity network, including operational switching, protective isolation and earthing, re-energisation and restoration of the normal network configuration, excluding regional and distribution substations. This person must be registered in Elektrilevi’s partner portal before the tenders are opened. The bidder must also have a designated person responsible for work operations, who must likewise be registered in the partner portal before the tenders are opened.
The bidder must have an electrical works manager with valid A-level competence and/or a qualification corresponding to at least level 6 under the Estonian Qualifications Act. The person must hold the relevant evidence of qualification when the tender is submitted and must be registered in the partner portal before the tenders are opened. The bidder must provide the name, position and contact details of the person signing the contract and of the contact person for contract-performance matters. A power of attorney must be submitted if the signatory’s authority does not arise from the articles of association.
