The bidder must confirm that none of the mandatory exclusion grounds under § 95(1), points 1–5 of the Estonian Public Procurement Act apply. These grounds include relevant convictions of the bidder or its representatives for organised crime, corruption, fraud, terrorist offences, money laundering, unlawful employment of foreign nationals, unlawful use of child labour or trafficking; outstanding state tax, customs or environmental charges or social security contributions; and circumstances in which awarding the contract would breach an international or Government of Estonia sanction. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; bankruptcy, liquidation or comparable insolvency proceedings; serious professional misconduct; anti-competitive agreements or coordinated conduct; an unmanageable conflict of interest; an unfair advantage arising from involvement in preparing the procurement; significant or repeated breaches of previous public contracts; false or misleading information or failure to provide requested evidence; tax-related offences; or lack of the legal right to submit a tender. The bidder must provide a team of at least six members consisting of field experts who participate personally and directly in performing the contract. The technology expert must have documented experience in a successful environmental impact assessment in the thermal energy sector. The air-quality, climate and noise experts must each have documented experience as a team member in a successful environmental impact assessment process. A successful assessment means an assessment approved by the Environmental Board. The lead expert must retain a valid licence throughout the contract period; foreign qualifications must be recognised by the competent authority under the applicable legislation. The bidder must prove the team’s existence and compliance with the tender. A separate, expert-signed CV must be submitted for each required expert, including the person’s name and personal identification code or date of birth, education and relevant work experience, confirmation of availability and consent to participate in contract performance, and confirmation of impartiality and objectivity. The bidder must maintain the required team throughout the contract and may replace members only with the contracting authority’s prior consent and with a person of at least equivalent competence. The tender must fully comply with the procurement documents; alternative, conditional or partial tenders are not permitted. The tender must remain valid for at least three months from the day following the tender submission deadline. The bidder must hold all licences, registrations and sector-specific authorisations required for the services, consent to verification of submitted information, and comply with Eesti Energia AS requirements for bidders and contract partners. Joint bidders must appoint an authorised representative and submit the relevant power of attorney.
