The bidder must confirm that neither it nor its representatives or members of its management or supervisory bodies have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Exclusion may also result from unpaid taxes or social security contributions, breaches of environmental, social or labour law, bankruptcy or other insolvency, liquidation, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, agreements restricting competition, a conflict of interest, involvement in preparing the procurement, or a material breach of a previous contract resulting in termination, compensation or a contractual penalty. The bidder must also not have submitted false information, failed to provide required information or documents, attempted to obtain confidential information, or improperly influenced the contracting authority’s decisions. Under Estonian law, additional grounds include offences related to enabling the employment of an unlawfully staying foreign national, breaches of international sanctions and tax offences. The bidder must confirm that taxes and social security contributions have been duly paid and provide supporting evidence where required. During contract performance, the bidder may not involve subcontractors or suppliers accounting for more than 10% of the contract value who are covered by Russian sanctions, including Russian citizens, residents or entities established in Russia, or persons connected with them through ownership, control or representation. The goods offered must not be subject to international sanctions or originate from a sanctioned region. The contracting authority may reject a tender if these requirements are breached; in certain cases, the bidder may provide evidence of remedial measures demonstrating restored reliability.

Within the 36 months preceding the start of the procurement, the bidder must have properly performed at least one travel arrangement services contract worth at least EUR 100,000 excluding VAT. A contract still being performed when the procurement starts may also be accepted if services worth at least that amount have been properly provided by that date. The bidder must provide the contract subject, customer, performance period and value of the properly performed services; the contracting authority may verify the information with the customer or other relevant sources. The bidder must be an International Air Transport Association (IATA) accredited ticketing agent and provide a copy of the evidence confirming the accreditation. The bidder must have a reporting system capable of providing a consolidated report of the previous month’s orders each month by the 10th calendar day at the latest. The report must include at least the service type, dates of use, the first and last name of the contracting authority’s employee using the service, and the destination; the data must be provided in a processable format and be extractable by employee, and must be retained for at least 12 months. The bidder must provide the contracting authority with a credit limit of EUR 20,000 including VAT for purchasing travel services. In the case of a joint tender, a power of attorney from the joint tenderers must be submitted. The tender must comply with all procurement document requirements, conditional tenders are not permitted, and the tender price must be submitted in the prescribed structure.
