Compliance requirements

A bidder confirms that neither it nor its representative or a member of its management or supervisory body has received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful child labour or human trafficking, unless any resulting exclusion period has expired. Where permitted by law, the bidder may describe measures taken to restore its reliability. Unpaid taxes or social security contributions may be grounds for exclusion. Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment where registration is required by that country's law. The bidder’s average annual net turnover for the last three financial years completed by the start of the procurement, 1 January 2023 to 31 December 2025, must be at least EUR 900,000. Joint bidders may aggregate their figures; if relying on another entity’s resources, the bidder must also provide that entity’s ESPD. The bidder, or the joint bidders collectively, must have acted as main contractor and completed at least one similar contract during the 60 months preceding the start of the procurement. A similar contract is a project to construct a public road that includes at least asphalt paving and utility networks; the client must have accepted the works. The bidder must provide details of the works and contracting parties, including the contract subject, duration and description of the similar works. The contracting authority may request evidence of proper completion. Another entity’s experience may be relied on only if that entity performs the relevant part of the contract itself. The works must be managed by a project manager who will participate directly in contract performance and hold at least a Level 7 chartered road engineer qualification, specialising in roads, or an equivalent qualification.
