Compliance requirements
The bidder must not be subject to mandatory exclusion grounds relating to convictions for participation in a criminal organisation, breach of duties of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; unlawful employment of foreign nationals or breaches of their employment conditions; or unlawful child labour or human trafficking. The bidder must also have no outstanding national tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment.
The contracting authority may exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has provided false information about meeting qualification requirements or failed to provide requested information or documents. Undertakings established in Russia or Belarus may not participate. The bidder must confirm that these grounds do not apply.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction work similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list stating each contract’s performance period, the other contracting party’s details and a contact person’s telephone number and email address, and the procurement reference number where applicable. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from a database without significant expense.
The bidder must have an electrical work supervisor with valid A-level competence and/or a qualification of at least level 6 under the Professions Act. The person must hold the relevant proof and be registered in Elektrilevi’s Partner Portal before bids are opened. The bidder must also have a worker with valid switching rights for the operations required on the 0.22–20 kV network, registered in the portal before bids are opened. For work involving medium voltage, both low- and medium-voltage switching rights are required; low-voltage-only work requires at least low-voltage switching rights. The bidder must also have a person appointed as responsible for the work operation, registered in the portal before bids are opened.
The bid must comply with all tender documents; conditional bids or bids containing additional conditions are not permitted. The bidder must submit a price table using the prescribed form and complete every unit-price field, taking account of the instructions for document V178. The bidder must identify the authorised contract signatory and the contract-performance contact person, providing their names, titles and contact details; a power of attorney must be included if the signatory’s authority does not arise from the articles of association. The bidder must also identify any information claimed as a trade secret and explain why it qualifies, or state that the bid contains no trade secrets. The bidder confirms that the materials, equipment and goods used in the works, including components, are not produced in or sourced from Russia or Belarus; certificates of origin may be requested.
