Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant convictions of the bidder or persons authorised to represent, manage or control it for participation in a criminal organisation, corruption or fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals or breaches of their employment conditions, and unlawful child labour or human trafficking. A bidder with outstanding state tax, payment or environmental-charge debt, or tax or social-security contribution debt under the law of its country of establishment, is also excluded.
The contracting authority may exclude a bidder that has seriously or persistently breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information about meeting the qualification criteria or failed to provide required information or supporting documents. The bidder must confirm that these voluntary exclusion grounds do not apply. Businesses established in Russia or Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
The bidder must have completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must submit a list stating the performance period and details of the other contracting parties, including the client representative’s telephone number and email address; for public contracts, the procurement reference numbers must also be provided. Evidence of proper performance must be supplied if requested, unless the contracting authority can obtain it from public or private databases without significant cost.
The bidder must have an electrical works supervisor with valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act. The person must hold evidence of the qualification when bids are submitted and be registered in Elektrilevi’s partner portal before bids are opened.
For switching operations related to the works, the bidder must have a worker with valid switching rights for the relevant voltage range and must have that worker registered in the partner portal before bids are opened. For low-voltage works only (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The training requirements are set out in document J387.
The bidder must also have a person designated as responsible for the work operation, registered in the partner portal before bids are opened. The applicable requirements are set out in documents J31 and J3284.
The bid must include the completed price table using the form provided in the procurement documents, with every unit-price field filled in, and must take account of the instructions for completing document V178. The bidder must provide details of the contract signatory or signatories and the contract performance contact person; a power of attorney must be included if the signatory’s authority does not arise from the articles of association. The bidder must identify and justify any information claimed as a trade secret. Materials, equipment and goods used in the works, including components, must not originate from or be produced in Russia or Belarus; the contracting authority may request certificates of origin.
