Compliance requirements
The bidder must confirm that no mandatory exclusion grounds apply. These include relevant convictions of the bidder or persons authorised to represent, direct or control it for participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling unlawful employment of foreign nationals or breaches of their employment conditions, including underpayment; child labour or human trafficking; and outstanding tax, payment or environmental-charge debts under Estonian law or the law of the bidder’s country of establishment.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, damages or a contractual penalty, or that has provided false information about meeting selection criteria or failed to submit requested information or documents. Bidders established in Russia or Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the procurement subject during the 60 months preceding the start of the procurement. At least one contract must be worth at least EUR 25,000 excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from public or private databases without significant expense.
The bidder’s team must include:
- A person authorised to carry out the switching operations required for the works in the 0.22–20 kV electricity network. The person must be registered in Elektrilevi’s partner portal before the tender opening. For work involving only low voltage (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including when low-voltage work requires switching on the medium-voltage side.
- A person designated as responsible for the work operation, registered in Elektrilevi’s partner portal before the submission deadline.
- A person leading the electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Qualifications Act, has the relevant evidence at the time of submission and is registered in Elektrilevi’s partner portal before the deadline.
The bid must comply with the tender documents, contain no qualifications or conditional terms, and include a completed price table using the prescribed form, with every unit-price field filled in. The bidder must provide the names, positions and contact details of the person or persons authorised to sign the contract and a contract-performance contact person. If signing authority does not arise from the articles of association, a power of attorney must be included. Joint bidders must appoint an authorised representative and provide the relevant power of attorney. Materials, equipment and goods used in the works, including components, must not be produced in or originate from Russia or Belarus; origin certificates may be requested.
