Compliance requirements
The bidder must confirm that neither it, its management or supervisory bodies, nor authorised representatives have relevant final convictions within the applicable five-year period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and other forms of trafficking in human beings.
The bidder must have fulfilled its tax and social security payment obligations. The notice sets the threshold for tax and social security debt at EUR 0; the stated national rule provides an exception where the debt is below EUR 100 or payment has been deferred. The bidder must also confirm that it is not in an insolvency, bankruptcy, liquidation or comparable situation, that its assets are not administered by a liquidator or court, and that its business activities are not suspended.
The bidder must not have committed serious professional misconduct, entered into arrangements intended to distort competition, have an unresolvable conflict of interest, participated improperly in preparing this procurement, or experienced serious or repeated failures in previous public contracts resulting in early termination, damages, price reduction or penalties. It must not have submitted false or misleading information, withheld required information, failed to provide requested documents, or sought confidential information or improperly influenced the contracting authority.
The bidder must also confirm compliance with environmental, social and labour-law obligations, the rules concerning employment of persons without a lawful basis to stay in the country, international sanctions requirements, and any applicable restrictions based on the bidder’s place of establishment. A conviction for tax offences is listed as a voluntary exclusion ground. Where permitted, evidence of remedial measures restoring reliability may be submitted.
Qualification criteria and exclusion grounds
The bidder or joint bidder that is required to be registered under its national law must be entered in the relevant commercial or equivalent register and provide a valid registration certificate or equivalent founding document. This requirement applies to all five lots.
For each lot, the bidder must demonstrate experience in selling the offered products by listing relevant contracts completed during the 36 months preceding the start of the procurement. At least one contract is required, and the total value of the similar contracts must be at least twice the value of the bid. The bid must include the contract description, value, dates, contracting authority and contact details, and other information requested in the tender documents.
The bidder must provide a technical description and manufacturer-issued technical data for every offered product. Depending on the lot and product, the bid must include the required evidence, including eco-label certificates or equivalent conformity audits for hand soap, certificates showing compliance with EN 1500 and EN 12791 for hand antiseptics, safety data sheets for products marked in Annex 3, valid manufacturer certificates to EN ISO 9001 and EN ISO 14001 or equivalent, and evidence of compliance with Directive 93/42/EEC or the Medical Device Regulation for the relevant surface disinfectants and impregnated wipes. Registered biocidal products require copies of their registration certificates.
The bidder must submit the declarations and price forms in Annexes 3 and 4, provide any required powers of attorney, confirm that samples can be supplied within seven days, submit prices in the prescribed structure including delivery costs, and explain any claimed equivalence with supporting evidence. The bid must be valid for at least three months. Exact product-specific technical requirements must also be checked in the tender documents.
