Development and Maintenance Works for the VAT Service

The bidder must confirm that neither it nor its representatives or controlling persons are subject to exclusion grounds, including final convictions within the last five years or continuing exclusion obligations for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations. The notice sets a EUR 0 threshold for these obligations; the tax authority may not issue a tax debt certificate where the debt is below EUR 100, excluding undetermined interest, or where payment has been deferred. The bidder must additionally confirm that it is not in bankruptcy, liquidation, insolvency proceedings or a comparable situation; has not seriously breached professional, environmental, social or labour obligations; has not seriously distorted competition; has no unresolvable conflict of interest; has not participated improperly in preparing the procurement; has not had previous public contracts terminated early or resulted in damages or comparable sanctions; and has not submitted false or incomplete information or failed to provide requested evidence. National exclusion grounds also cover enabling unlawful employment of foreign nationals, being subject to an international sanction, and any other applicable national-law exclusion ground. Where relevant, the bidder may provide evidence of remedial measures demonstrating reliability, subject to the applicable legal conditions. During contract performance, first-tier subcontractors will be checked. The bidder must confirm that it will not use subcontractors or suppliers exceeding 10% of the contract value that are Russian nationals, residents or entities established in Russia, entities more than 50% directly or indirectly owned by them, or persons acting on their behalf or instructions. Subcontractors and suppliers must be established in Estonia, another EU Member State, an EEA contracting state or a WTO Government Procurement Agreement country.

The bidder must have completed, during the 36 months preceding publication of the contract notice, four separate contracts meeting all of the following requirements: at least one contract worth at least EUR 35,000 for preparing a business analysis; at least one contract worth at least EUR 75,000 for preparing a systems analysis; and at least two contracts worth at least EUR 300,000 each involving system architecture, information-system development, testing and deployment. The contracts may not be combined, and framework agreements alone are not accepted as references. The relevant works must have been delivered to and accepted by the client; phased delivery is acceptable where the completed and accepted work meets the required scope and value. The bidder must submit the contract list in the ESPD, including the value, contracting party and contact details, work description, contract period and, where applicable, the procurement reference number. The bidder must have a software-development quality assurance system meeting at least ISO 9001:2015 or an equivalent standard, demonstrated by a valid certificate or equivalent evidence from an independent auditor or accredited certifier. The tender must include a six-person project team covering five roles: senior project manager, senior systems analyst, software architect/senior developer, senior developer and tester. One person may not perform more than one role. CVs must be submitted using the prescribed forms, clearly demonstrate compliance and additional experience, and be digitally signed by the relevant specialist. The bidder must accept all procurement-document requirements, include all work and activities necessary to achieve the contract objective, submit the hourly rate for development and maintenance work in euros excluding VAT using the prescribed price form, and explain any claimed trade secrets. The tender must comply with the procurement documents; where equivalence is relied upon, the bidder must explain it and provide supporting evidence. For joint tenders, the parties must appoint an authorised representative and submit the power of attorney and confirmation of joint and several liability. The bidder must also provide the required confirmations concerning environmental requirements, sanctions, subcontractors and suppliers.
