Compliance requirements

The bidder must confirm that neither the bidder nor its management or supervisory board members, authorised representatives, prosecutors or other persons authorised to represent or control it have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, unlawful employment-related offences, illegal use of child labour or human trafficking offences. The bidder must also have no outstanding state tax, payment or environmental charge debts, or tax or social security contribution debts. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous procurement contract, contract termination, price reduction, compensation payment or contractual penalty, as well as for submitting false information or failing to submit required information or documents. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate.

Qualification criteria and exclusion grounds

During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this contract. At least one of them must have had a value of at least EUR 150,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and procurement reference numbers where applicable. Upon request, evidence of proper performance must be provided. The team must include a person with the switching rights required for work on a 0.22–20 kV electricity network, entered in Elektrilevi’s partner portal before the tenders are opened. For low-voltage works, at least MP switching rights are required; in other cases, both MP and KP switching rights are required. The team must also include a person responsible for the work operation, entered in the same portal before the tender submission deadline, and a person managing the electrical works who holds valid A competence or a qualification corresponding to at least level 6 under the Vocational Qualifications Act, the relevant proof and a portal entry. The tender must comply with all procurement documents; conditional tenders or tenders containing additional conditions are not permitted. A fully completed price table, including all unit-price fields, must be submitted, and the instructions for completing management-system document V178 must be followed. The bidder must provide the details of the contract signatory and the contact person for contract performance and, where necessary, attach a power of attorney. In a joint tender, a power of attorney for the joint tenderers must be submitted. The tender must identify and justify any trade secrets or state that it contains none; the tender price and other prohibited figures may not be classified as trade secrets. Materials, equipment, goods or components originating from Russia or Belarus may not be used in the works, and the contracting authority may request certificates of origin. The bidder must take into account a payment period of 14, 35 or 45 calendar days depending on the contract value; participation in the factoring programme results in a 95-calendar-day payment period.
