Compliance requirements
A bidder will be excluded if the company or a person with management, supervisory or representation authority has a relevant conviction for participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism, money laundering or terrorist financing. Exclusion also applies where there is a conviction for allowing an unlawfully residing foreign national to work or for paying a foreign national less than the legally required wage, or for the unlawful use of child labour or an act related to human trafficking. The bidder must not have outstanding state tax, payment or environmental charge debts, or tax or social security contribution debts in its country of establishment.
The contracting authority may also exclude a bidder for a substantial or repeated breach of a previous public contract if this resulted, for example, in withdrawal from the contract, termination, a price reduction, compensation for damage or a contractual penalty. Providing false information about compliance with the qualification requirements or failing to submit required information or documents may also constitute grounds for exclusion.
A bidder must confirm that none of the mandatory or discretionary exclusion grounds apply. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components originating from or produced in Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin as proof.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, information about the other contracting parties and the contracting authority's representative's contact details, as well as procurement reference numbers where applicable. Upon request, the bidder must provide evidence of proper performance.
The bidder must have an employee with valid switching authorisations for work-related switching operations in a 0.22–20 kV electricity network, registered in Elektrilevi's partner portal before tenders are opened. For low-voltage works only, at least low-voltage switching authorisations are required; in other cases, both low- and medium-voltage switching authorisations are required. The bidder must also have a person responsible for the work operation, referred to as the C-person, registered in the same portal before tenders are opened.
The person leading the electrical works must hold valid A-level competence or a qualification of at least level 6 under the Estonian Vocational Qualifications Act, possess supporting evidence and be registered in Elektrilevi's partner portal before tenders are opened.
The tender must include a properly completed price table with all unit-price fields completed and must comply with all tender document requirements. Conditional tenders and tenders containing additional conditions are not permitted. The bidder must provide the name, position, contact details and basis of representation of the contract signatory, together with the contact person's details for contract performance; a power of attorney must be included if the authority to represent does not arise from the articles of association.
The bidder must take account of the contracting authority's standard payment periods: 14 calendar days for a contract value up to EUR 59,999, 35 calendar days for a value of EUR 60,000–249,999 and 45 calendar days for a value of EUR 250,000 or more. Participation in the factoring programme results in a 95-calendar-day payment period. The tender must identify any trade secrets and explain their designation; the tender price and other numerical indicators related to evaluation cannot be designated as trade secrets.
