Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder and its relevant management, supervisory and representative persons must not have a final conviction within the last five years, or a continuing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must not have breached its tax or social security contribution obligations. The stated threshold is EUR 0; under Estonian rules, a tax-debt certificate is not issued where the relevant tax debt is below EUR 100 or payment has been deferred. For foreign bidders, tax-debt evidence is issued under the rules of their country of establishment. The bidder must also confirm that entering into the contract would not breach an international or Estonian government sanction. Where an exclusion ground applies, evidence of remedial measures may be submitted to demonstrate reliability if the procurement exceeds the EU threshold or the procurement documents provide for this possibility.

Qualification criteria and exclusion grounds

The bidder must provide an owner’s supervision specialist holding at least a Level 6 construction engineer qualification, specialised in building construction and competent in owner’s supervision, or an equivalent qualification. The bidder must identify the specialist and provide the professional certificate number if the information is available in the Estonian Register of Professions; otherwise, a copy of the diploma or professional certificate must be included with the bid. The bid must accept all procurement-document conditions, be unconditional and include the required documents and forms. If submitted by a representative whose authority does not arise from law, the bid must include the power of attorney on Form 1. Joint bidders must appoint an authorised representative, submit the power of attorney on Form 2 and accept joint and several liability for contract performance. The price must be submitted using Form 4, in euros both excluding and including VAT, to two decimal places. It must cover all costs necessary to perform the works, including taxes, duties, overheads, profit and other customary necessary costs not separately described in the procurement documents. Where an equivalent solution is offered, its equivalence must be explained and supported by evidence.
