Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that none of the exclusion grounds set out in § 95(1) of the Estonian Public Procurement Act applies. Before concluding the framework agreement, the contracting authority will check that the successful bidder is not subject to those grounds and may request supporting evidence if necessary. The bidder must confirm that it will not involve, in performing the contract, Russian nationals, residents or entities established in Russia—or entities directly or indirectly more than 50% owned by them, or acting on their behalf or under their instructions—for more than 10% of the contract value. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate in a sanctioned region. The contracting authority will reject a bid if the resulting contract would be void under applicable sanctions legislation.

Qualification criteria and exclusion grounds

The bid must accept all conditions in the procurement documents; conditional bids are not permitted. The bidder must provide the name and position of the person authorised to sign the contract, state whether that authority arises under the company’s constitutional documents or a power of attorney, and provide a power of attorney if applicable. It must also give the name, telephone number and email address of the proposed contract contact person. The price offer must follow the structure specified in the pricing form. The technical offer must be prepared using Annex 1, the technical description and bid form, and must comply with the technical specification. The offered product must bear the CE marking and comply with Medical Device Regulation (EU) 2017/745. The bidder must provide the manufacturer’s conformity documents, a product description in Estonian and/or English, and manufacturer-issued technical documentation sufficient to verify the product’s characteristics and compliance. Each product package must show the product name and code, the date indicating sterility or shelf life, the size or dimensions, and the EAN/GTIN code; the manufacturer must confirm compliance with this packaging requirement. Where bidders submit a joint bid, they must appoint an authorised representative and provide the power of attorney. The bidder must identify any information claimed as a trade secret and explain why; the bid price and other specified price or evaluation-related numerical information may not be designated as trade secrets. No specific financial-capacity, turnover or prior-experience thresholds, or award criteria, are stated in the provided documents.
