Compliance requirements
Exclusion grounds cover final convictions within the last five years, or a continuing exclusion period, involving the bidder or members of its representative, management or supervisory bodies for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing, unlawful use of child labour or human trafficking.
A bidder may also be excluded for failing to meet tax or social security contribution obligations in Estonia or in its country of establishment. The stated threshold for tax debt is EUR 0; the notice explains that the tax authority does not issue a certificate where the debt is below EUR 100 or payment has been deferred. The authority will also check whether awarding the contract would breach an international sanction or a sanction imposed by the Government of Estonia. Where an exclusion ground applies, the bidder may provide evidence of remedial measures to restore its reliability if this is permitted for the procurement.
