Compliance requirements
A bidder may be excluded if the bidder, or a person in its management, supervisory or control body, or a person authorised to represent or control it, has a relevant conviction within the past five years or remains subject to an exclusion period. The listed offences are participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking.
Exclusion grounds also include unpaid taxes or social security contributions, enabling a foreign national to work without legal grounds or in breach of applicable employment conditions, and a contract that would violate an international or Estonian government sanction. The notice sets the tax and social contribution arrears threshold at EUR 0; the accompanying explanation states that Estonian tax authorities do not issue a tax-debt certificate where the debt is below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled. Where permitted for this procurement, the bidder may provide evidence of measures taken to restore its reliability.

One person may perform more than one role if qualified for each. The bidder must provide the responsible persons’ details in the ESPD or copies of documents proving their professional qualifications.
The bid must include the price schedule. The bidder must confirm compliance with the procurement documents; conditional bids are not permitted. For a joint bid, a power of attorney for the joint bidders must be included, and the bid must identify the contract signatory and the contact person for contract performance. Any trade secrets must be identified and the designation justified; the bid price and figures used to assess the award criteria may not be designated as trade secrets. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The supplied text does not specify the award criteria.
