Compliance requirements
The tenderer may be excluded if, within the last five years or while an exclusion period remains in force, it or a person with management, supervisory or representative authority has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful child labour or human trafficking. The tenderer must also meet its tax and social security contribution obligations; the notice sets the threshold at EUR 0, while noting that in Estonia a tax-debt certificate is not issued for debt below EUR 100 or where payment has been deferred. A tenderer is also subject to exclusion if awarding the contract to it would breach an international or Estonian government sanction. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The tenderer’s average net turnover in stray pet capture and/or boarding must have been at least EUR 200,000 over the last three financial years completed by the start of the procurement. During the 36 months before the procurement began, the tenderer must have completed at least one contract for capturing and boarding stray pets, worth at least EUR 100,000 per 12-month service period, excluding VAT. The reference must be evidenced with a description of the service, dates, value completed during the reference period and details of the other contracting party, including a contact person’s telephone number and email address. Only work completed and accepted during the reference period counts; for framework agreements, completed contracts or orders under the framework may be used. The tenderer must have all technical equipment, inventory and personnel needed to provide the service properly and must confirm that it will perform the service under the tender documents’ conditions. A joint tender must include written authorisation for one tenderer to represent the other. The tenderer must state whether the bid contains trade secrets and, if so, explain why the information qualifies. It must submit the pricing form based on Annex 4. The tenderer must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value, or rely on their capacities to meet the qualification requirements, where those entities fall within the categories specified in tender-document clauses 4.3.1–4.3.3. No specific award-scoring criteria were included in the supplied materials; check the tender documents for details.
