Compliance requirements
The bidder must declare whether, within the past five years or while an exclusion period remains in force, it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The bidder may describe measures taken to restore its reliability where the applicable rules allow this.
Exclusion may also apply for unpaid taxes or social-security contributions. The notice sets a threshold of EUR 0; the document notes that an Estonian tax-debt certificate is not issued where the relevant debt is below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled. Foreign bidders are assessed under the rules of their country of establishment.
Other stated grounds include enabling a foreign national without a lawful basis to work, including breaches involving legally required pay, and being subject to an international sanction that would make the contract unlawful. The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers who are Russian nationals, residents or entities established in Russia, entities more than 50% owned by them, or persons acting on their behalf or instructions. Goods that are subject to international sanctions or originate in sanctioned territories are not permitted. First-tier subcontractors are checked for the stated exclusion grounds.
Qualification criteria and exclusion grounds
For all four lots, the bidder must be registered in the business register of its country of establishment. Net annual turnover must be at least EUR 1,500,000; the requirement concerns the relevant financial year or years within the period specified in the procurement documents, up to the last three completed financial years.
During the 60 months before the procurement commenced, the bidder must have completed at least two contracts for constructing, reconstructing or installing a membrane wastewater treatment plant with a pollution load of at least 150 population equivalents, and at least two contracts for constructing, reconstructing or installing a reverse-osmosis water-treatment plant with a capacity of at least 30 m³ per day. A contract may have started earlier than that 60-month period if the works were completed within it. The bidder must list the qualifying contracts in the European Single Procurement Document and provide evidence of proper completion if requested.
The bid must meet the tender-document requirements and be unconditional. Prices must follow the structure specified in the pricing schedule. Where a joint bid is submitted, the bidders must appoint an authorised representative and include their power of attorney. The bidder must identify and justify any information claimed as a trade secret; the bid price and evaluated numerical indicators may not be treated as trade secrets. The bidder must confirm that it will not use a subcontractor subject to replacement under the applicable rules. Where an equivalent solution is offered, the bidder must explain the equivalence and provide supporting evidence; other appropriate evidence may be accepted where the stated conditions are met. No specific award-scoring method is stated in the provided documents.
