Compliance requirements
The bidder must not be subject to mandatory exclusion grounds. These include relevant criminal convictions of the bidder or a person in its administrative, management or supervisory body, a procurator, or another person authorised to represent, decide for or control the bidder. The offences include participation in a criminal organisation, breach of integrity or corruption, fraud, terrorist offences, money laundering or terrorist financing; enabling the unlawful employment of a foreign national or breaches concerning a foreign national’s employment conditions in Estonia, including payment below the statutory minimum; and unlawful use of child labour or human trafficking. A bidder with tax, duty or environmental-charge arrears under Estonian law, or tax or social security contribution arrears under the law of its country of establishment, is also subject to exclusion.
The contracting authority may exclude a bidder for a serious or persistent breach of an earlier public contract that led to termination, withdrawal, a price reduction, damages or a penalty. It may also exclude a bidder that provided false information about meeting the qualification requirements or failed to provide that information or requested supporting documents.
Companies established or resident in the Russian Federation or the Republic of Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including the client representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bid must comply with all procurement documents; conditional bids and bids containing additional conditions are not permitted. The price must be submitted using the prescribed table, with every unit-price field completed, and prepared in accordance with the instructions for document V178.
The bidder must have a worker with valid switching rights for the switching operations required by the works in 0.22–20 kV electrical networks, excluding regional and distribution substations. That worker must be registered in Elektrilevi’s partner portal before bids are opened. For works limited to low voltage (0.22–1 kV), at least low-voltage switching rights are required; otherwise both low- and medium-voltage switching rights are required, including where low-voltage works necessitate switching on the medium-voltage side (over 1–20 kV). The bidder must also have a person appointed as responsible for the work operation, registered in the partner portal before bids are opened.
The bidder must have a person leading the electrical works who holds a valid A-category competence and/or a qualification at least at level 6 under the Vocational Qualifications Act, possesses the relevant evidence by the bid submission deadline and is registered in the partner portal before bids are opened.
The bidder must identify the contract signatory or signatories, provide their titles and contact details, and name a contact person for contract-related matters. If signing authority does not arise from the articles of association, a power of attorney must be included.
Standard payment periods, counted from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts valued from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from Russia or Belarus. The contracting authority may request certificates of origin.
