Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds under § 95(1) of the Estonian Public Procurement Act apply. These include relevant convictions involving the bidder or its representatives, tax or social security contribution arrears, and a contract that would breach international or Estonian government sanctions.
The contracting authority may also exclude a bidder on the grounds listed in § 95(4), including breaches of environmental, social or labour law; insolvency or liquidation; serious professional misconduct; anti-competitive conduct; conflicts of interest or an advantage arising from involvement in preparing the procurement; serious or persistent failures under previous public contracts; false or withheld information; attempts to improperly influence the contracting authority or obtain confidential information; tax-related offences; or lack of a legal right to participate. Participation is prohibited for businesses established or resident in Russia or Belarus. The bidder must also confirm that the offered goods are not subject to international sanctions or from sanctioned regions.
Qualification criteria and exclusion grounds
The bidder must have completed at least two comparable contracts during the 36 months preceding the start of the procurement. Each contract must have a value of at least EUR 200,000 excluding VAT. For an ongoing contract, only goods delivered to and accepted by the customer by the start of this procurement count towards the required value. Submit a list of the contracts, stating their values, performance periods and dates, and the other parties’ details, including a contact person, telephone number and email address; for public procurement contracts, also provide the procurement reference number. At least two references must be submitted.
The bidder must submit a copy of a PCI DSS certificate or other specified proof. Where a joint tender is submitted, the joint bidders must appoint an authorised representative and include the relevant authorisation with the tender. The tender must comply with the procurement documents and may not be conditional. Prices must be submitted in the structure specified in the price evaluation sheet. Any claimed equivalence must be explained and supported by evidence. The bidder must identify and justify any trade secrets, but may not classify the tender price or other specified evaluation figures as trade secrets. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
