Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that no mandatory exclusion ground applies. These include relevant convictions of the bidder or its representatives for participation in a criminal organisation, breach of integrity or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment of foreign nationals or breaches of their employment conditions, including underpayment; offences involving unlawful child labour or human trafficking; and outstanding state taxes, duties or environmental charges, or tax or social-security contributions owed under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder that has materially or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, damages or a contractual penalty, or that has provided false information about meeting qualification requirements or failed to provide such information or requested supporting documents. Companies established in the Russian Federation or Belarus are not permitted to participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement; at least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must submit a list stating each contract’s performance period, the other contracting party and its representative’s contact details, including telephone number and email address, and the procurement reference number where applicable. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from a public or private database without significant cost. The team must include a person with valid switching rights for the switching operations required for the works and registered in Elektrilevi’s partner portal before the relevant deadline. For low-voltage works only (0.22–1 kV), low-voltage switching rights are required; otherwise both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The team must also include a person responsible for the work operation, registered in the partner portal before the submission deadline, and a person directing electrical works who holds valid A-level competence or a qualification of at least level 6 under the Professions Act, has the relevant evidence at the time of submission and is registered in the portal before the deadline. The bid must include a price table in the prescribed format with every unit-price field completed. Conditional bids or bids containing additional conditions are not allowed. The bidder must accept the procurement documents’ terms. The bidder must provide the name, position and contact details of the contract signatory and a contract-performance contact person; a power of attorney must be included if the signatory’s authority does not arise from the articles of association. The bidder must identify and justify any information claimed as a trade secret; bid prices and specified evaluation-related figures may not be classified as trade secrets. Standard payment periods, counted from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The supplied documents do not specify an award criterion.
