Compliance requirements
The bidder will be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of professional integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences related to enabling the unlawful employment of foreign nationals or paying them below the legally required rate; or unlawful child labour or human trafficking. A bidder with outstanding state tax, payment or environmental charges, or tax or social-security contributions due under the law of its country of establishment, will also be excluded.
The contracting authority may exclude a bidder for a serious or persistent breach of an earlier public contract that resulted in termination, withdrawal, a price reduction, damages or a contractual penalty. It may also exclude a bidder that supplied false information about meeting qualification requirements or failed to provide requested information or additional documents. Businesses established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must provide a list stating the performance period, information about the other contracting parties and their representatives’ contact details, including telephone and email, and, for public contracts, the reference numbers. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from a database without significant cost.
The bidder must have a worker with valid switching rights for the switching operations required for the works, registered in Elektrilevi’s partner portal before bids are opened. For work requiring medium-voltage switching, both low-voltage and medium-voltage switching rights are required; for low-voltage-only work, low-voltage rights are sufficient. The bidder must also have a person designated as responsible for the work operation, registered in the portal before bids are opened.
The bidder must have an electrical works manager with valid A-class competence and/or a qualification of at least level 6 under the Professions Act. The manager must hold the relevant proof by the bid submission deadline and be registered in the partner portal before bids are opened.
The bid must accept all procurement-document conditions and may not be conditional or include additional conditions. The price must be submitted using the prescribed table, with every unit-price field completed. The bidder must provide the name, position and contact details of the person(s) authorised to sign the contract, the basis of their authority, and the contact person for contract matters. A power of attorney must be included if signing authority does not arise from the articles of association.
The standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days.
The bidder must identify any business secrets in the bid and explain why they qualify as such. The bid price, partial prices, and applicable price-evaluation figures may not be treated as business secrets. Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
