Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if it, or a person with powers of representation, decision-making or control, has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the employment of foreign nationals unlawfully or in breach of employment conditions; or unlawful child labour or human trafficking. Exclusion also applies where the bidder has outstanding national taxes, duties or environmental charges, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract that resulted in termination, withdrawal, a price reduction, damages or a contractual penalty, or for providing false information or failing to provide information or additional documents required to demonstrate compliance with qualification criteria. Companies established in Russia or Belarus may not participate in the procurement.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months before the procurement commenced. At least one contract must be worth €40,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address), and the procurement reference number where applicable. At the contracting authority’s request, the bidder must provide evidence of proper performance, unless the authority can obtain the information from public or private databases without significant expense. The team must include: - A person with valid switching authorisations for the switching operations required for the works in 0.22–20 kV electricity networks, excluding regional and distribution substations. For works involving only low-voltage installations (0.22–1 kV), low-voltage switching authorisation is sufficient; otherwise, both low- and medium-voltage authorisations are required. This person must be registered in Elektrilevi’s partner portal before the bids are opened. - A person designated as responsible for the work operation, registered in Elektrilevi’s partner portal before the bid submission deadline. - A person leading the electrical works who holds valid A-level electrical competence and/or a qualification of at least level 6 under the Professions Act, has the relevant proof when submitting the bid, and is registered in the partner portal before the submission deadline. The bid must include a price table using the prescribed form, with every unit-price field completed, and must comply with the tender documents without additional or conditional terms. The bidder must provide the authorised signatory’s name, position and contact details, as well as those of the contract-performance contact person; a power of attorney must be included if the signatory’s authority does not arise from the articles of association. The bidder must confirm that the materials, equipment, goods and components used in the works are not produced in or originating from Russia or Belarus; the authority may request certificates of origin. The bidder must identify and justify any information claimed as a trade secret, but may not classify the price or other specified evaluation-related figures as trade secrets. The tender documents set standard payment periods of 14 calendar days for contracts up to €59,999, 35 days for contracts from €60,000 to €249,999, and 45 days for contracts of €250,000 or more; participation in the authority’s factoring programme entails a 95-day payment period. No award criterion is specified in the supplied documents.
