Purchase of computer equipment

The bidder may be excluded if it, or a person in its management, supervisory or representative bodies, has a relevant conviction within the past five years or remains subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. Exclusion may also apply for unpaid taxes or social security contributions. The notice sets the threshold at EUR 0; under the stated national rules, tax arrears below EUR 100, excluding interest not established by an administrative act, or arrears whose payment has been deferred, do not result in a tax-debt certificate being issued. A further mandatory ground concerns enabling a foreign national without a lawful basis to work, or breaches of the conditions for employing a foreign national in Estonia, including payment below the statutory wage rate. The bidder must also confirm that awarding the contract would not breach international or Estonian government sanctions. Where an exclusion ground applies, evidence of remedial measures may be submitted if the applicable rules or tender documents allow it.

The bidder must be entered in the relevant business register in its country of establishment. It must also have duly completed at least two similar computer-equipment sales contracts during the 36 months preceding the procurement, including sales of computers, with a total value of at least EUR 20,000 excluding VAT. The bidder must provide details of each contract, including its subject, value, the other contracting party’s name and registration code, and the contract start and end dates. On request, the bidder must provide the customer’s confirmation that the contract was properly performed. The bid must comply with the tender documents; conditional bids are not permitted. Prices must be submitted in euros, excluding VAT, using the prescribed electronic price form and Form 1, which must include product descriptions and unit prices. If the amounts differ, the amount in Form 1 will prevail. Product descriptions must include all technical data required by the product specifications; a product code alone is insufficient. Where applicable, the bidder must explain equivalence and provide supporting evidence. The bidder must offer a valid warranty from delivery: at least two years, with a three-year warranty required for certain products. The warranty must cover repair and a replacement product while repairs are carried out, including battery defects, without additional charges. The bid must declare REACH candidate-list substances present above 0.1% by weight in the products and specified components, or their absence, and provide supporting evidence. The bidder must arrange reuse and recycling of end-of-life equipment in accordance with Directive 2012/19/EU and describe how collection, confidential handling of storage media and data deletion, and dismantling for recycling or disposal will be carried out. If the bidder is not part of a producer responsibility organisation, it must provide evidence of cooperation with an authorised waste operator or, if it handles waste itself, a relevant environmental permit. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must also provide the required information and evidence concerning any business secrets claimed in the bid.
