Compliance requirements
A bidder may be excluded if it, or a person in its management, supervisory or governing body or authorised to represent, make decisions for or control it, has been convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking, or remains subject to an exclusion period imposed by a conviction. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. A bidder may also be excluded for unpaid taxes or social security contributions in its country of establishment or in Estonia. The stated threshold is EUR 0; the notice explains that, under Estonian tax rules, a tax-debt certificate is not issued where the relevant debt is below EUR 100 or payment has been deferred. A bidder may also be excluded if entering into the contract would breach an international or Estonian government-imposed sanction. The bidder must confirm its position on these grounds; the contracting authority may request further information or evidence where there is reasonable doubt.
Qualification criteria and exclusion grounds
The bidder must have specific annual turnover in the relevant product area—paper products and polyethylene waste and refuse bags—of at least EUR 200,000 over the required three financial years. The notice does not clarify whether this minimum applies to each year or to the period as a whole.
The bidder must submit the completed product description form and the prescribed price form, and structure its price offer as required by the tender documents. Products listed in positions 1–7 of Annex 1-1 must each hold a valid Type I ecolabel: EU Ecolabel, Nordic Ecolabel, Der Blaue Engel or an equivalent label. For each product, provide the manufacturer and product name, label name and licence or certificate number, together with a valid licence/certificate copy or a link to the product entry in the label issuer’s public register. For an equivalent label, provide evidence that its requirements are equivalent to those of at least one specified label for the relevant product group. Other relevant evidence may be accepted under the applicable rules; a manufacturer’s environmental management certificate alone or a general environmental claim is not sufficient. Ecolabels do not replace the other product requirements in Annex 1-1.
The bidder must have an e-ordering environment and enable approximately 80 of the contracting authority’s employees to place orders through it. The offer must comply with the tender documents; where equivalence is relied upon, explain it and provide supporting evidence. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. For a joint bid, submit the joint bidders’ authorisation. If the person submitting or signing the offer is not shown as authorised in the commercial register, provide evidence of that person’s authority. Identify and justify any information claimed as a trade secret; the offer price and evaluation-related figures may not be designated as trade secrets.
