Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it or its relevant representatives have been convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or human trafficking offences. The bidder must also declare whether it has breached tax or social security payment obligations; is bankrupt, insolvent, being liquidated, subject to insolvency proceedings, has suspended business or has made an arrangement with creditors; or has seriously breached professional conduct rules, environmental, social or labour obligations, or competition rules. Declarations are also required concerning conflicts of interest, involvement in preparing the procurement, early termination or sanctions under previous contracts, false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or improperly influence the procurement. National grounds include enabling a foreign national to work unlawfully, being subject to applicable international sanctions, tax offences, and any restriction on the bidder's right to participate based on its place of establishment. Where a relevant ground applies, the bidder may be asked to provide details and, where permitted, evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must meet both of these qualification requirements: - Its net turnover must have been at least EUR 100,000 in each of the last three completed financial years. For bidders whose financial year is the calendar year, the relevant years are 2023, 2024 and 2025. Turnover must be stated separately for each year in the European Single Procurement Document (ESPD). - The bidder must provide details of at least one completed contract for the sale of minibuses, performed during the 36 months preceding the contract notice, with a value of at least EUR 40,000 excluding VAT. The details must include the client, a description of the contract, its performance period and value, and the client's contact information. If the contract began earlier or is still ongoing, state the value performed during the relevant 36-month period. The bid must include a technical proposal identifying the vehicle's make, model and full technical specifications, with enough information to demonstrate compliance with the technical specification. The bidder must identify manufacturer-approved or authorised service points for maintenance, warranty work and repairs in Tartu or a neighbouring municipality, or provide evidence of a binding arrangement for such services, including addresses and contact details. The vehicle's general warranty must cover at least 4 years or 100,000 km, whichever occurs first; the high-voltage battery warranty must cover at least 8 years or 160,000 km, whichever occurs first. The bid must include the required confirmations, including that the goods are not subject to international sanctions, that the bidder accepts the procurement documents and can perform the contract on the offered terms. The bid must remain valid for at least 3 months from the submission deadline. If the bid is successful, the signed contract must be returned within 5 calendar days of receiving the contract signed by the buyer. A person submitting the bid who is not the bidder's legal representative must provide proof of authority using the prescribed form. Joint bidders must submit the prescribed power of attorney and confirmation of joint and several liability; an ESPD is required for each joint bidder. The bidder must also identify any persons authorised to represent, make decisions for or control it whose details are not available in the relevant register, or confirm that there are no such persons. Any claimed trade secrets must be identified and justified.
