Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded if it is bankrupt, being wound up, subject to bankruptcy or liquidation proceedings, has suspended its business, or is in an equivalent situation under the law of its country. Exclusion also applies for outstanding taxes, duties, environmental charges, or social security contributions, unless the debt is paid or rescheduled, including within 10 calendar days after notice of the ground for exclusion. The bidder must have no exclusion grounds under the specified provisions of the Estonian Public Procurement Act. The bidder’s employees’ average wage during the relevant comparison period must be at least 70% of the average wage for the same period in the contract’s field; this does not apply where the bidder has no employees. The comparison period is six calendar months ending two months before the calendar month in which the procurement began. For a bidder established or commencing business later, the period starts in the month of establishment or commencement and ends at the same specified end point. Foreign bidders must provide equivalent evidence from the competent authority in their country. The bidder must not be a related party of the technical consultant advising the beneficiary on the apartment building’s renovation. Submit the Tax and Customs Board’s digitally stamped extract showing employees’ average wages and a confirmation that no relevant convictions exist; joint bidders must provide the relevant extracts and confirmations for all members. If evidence cannot be checked in public registers and was not submitted with the bid, the bidder may be given 10 calendar days to provide it.

Qualification criteria and exclusion grounds

The bidder must hold the required economic activity notices for construction, including general construction, indoor climate systems, and building water supply or sewerage systems. For electrical work, it must also hold a notice covering construction and installation of electrical installations. Foreign bidders may provide equivalent evidence. The bidder’s net turnover in the financial year preceding submission must be at least twice the estimated contract value, excluding VAT. In a joint tender, one member must meet this requirement individually; turnover cannot be aggregated. The bidder must confirm that it can provide a construction-period performance guarantee equal to 5% of the construction contract price, issued by a credit or financial institution. If the contract is signed before the guarantee is submitted, it must be provided within 10 calendar days of signing and remain valid throughout the construction period. A deposit to the beneficiary’s or a notary’s account is also accepted under the stated conditions; joint bidders may provide the guarantee jointly. During the 60 months preceding commencement of the procurement, the bidder must have completed at least one equivalent construction project worth at least half the estimated contract value. The project must have involved erecting, extending or comprehensively renovating a building as main contractor, including work on load-bearing structures and external enclosures, heat-recovery mechanical ventilation, and a new heating system. Completion must be evidenced by a signed handover and acceptance certificate or by relevant building-register data. Submit the information using Form 5. The team must include a project manager with at least a level 6 building engineer qualification specialising in building construction and the relevant construction management competence, or an equivalent level 6 construction manager qualification; a site manager with at least a level 5 construction foreman qualification specialising in general construction; a heating and ventilation specialist with at least a level 6 heating, ventilation and cooling engineer qualification with the specified construction management competences, or an equivalent level 6 construction manager qualification; and a water supply and sewerage specialist with at least a level 6 qualification in the relevant engineering field and construction management competence, or an equivalent level 6 construction manager qualification. For electrical work, the responsible person must hold at least a Class B competence certificate or a level 6 electrical engineer qualification for consumer electrical installations. Provide each specialist’s name and qualification certificate number; the contracting authority will verify the qualifications. The bidder must operate a construction-sector quality management system meeting at least EVS-EN ISO 9001 and an environmental management system meeting at least EVS-EN ISO 14001, or equivalent requirements. Submit copies of the certificates or equivalent documents. The bid must include the total price and the completed construction price schedule (Form 3). The bidder must identify and justify any information claimed as a trade secret and confirm compliance with the tender documents. For a joint bid, include the members’ power of attorney. The price and turnover information must be submitted using the prescribed forms.
