Compliance requirements
The bidder must confirm that none of the exclusion grounds under § 95(1), points 1–5 of the Estonian Public Procurement Act apply. These grounds concern specified serious criminal convictions involving the bidder or relevant persons representing, managing or controlling it; convictions for unlawfully employing foreign nationals or breaching the conditions of their employment, including paying less than the legally prescribed wage; convictions related to unlawful child labour or human trafficking; outstanding national tax, payment or environmental-charge debts, or equivalent tax or social-security debts under the law of the bidder's country of establishment; and a contract award that would breach an international or Estonian government-imposed sanction.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment where registration is required by that country's law. A bidder established in Estonia does not need to submit a copy of its register entry.
The bidder and/or its subcontractor must have completed at least one contract for a similar service involving air-emission measurements during the 36 months preceding the start of the procurement. The bidder must submit the contract list using Form 2, stating each contract's name, brief description, performance period and other contracting party. If relying on another entity's experience, that entity must be identified in the procurement register and must personally perform the relevant part of the contract.
By the submission deadline, the bidder and/or its subcontractor must hold valid accreditation covering the measurements, sampling and analyses needed to perform the contract. The bidder must provide copies of documents proving the accreditation and its scope. If relying on another entity's accreditation, that entity must be identified in the procurement register.
The emission measurements must be carried out by an accredited laboratory using accredited methods and relevant standards. Equivalent solutions may be offered; where applicable, the bidder must explain the equivalence and provide supporting evidence.
The bid must meet the tender-document requirements; conditional bids are not permitted. Prices must follow the specified pricing structure, and all fields in Form 1, the bid price form, must be completed without deleting rows. Joint bidders must appoint an authorised representative and include their power of attorney. The bidder must identify and justify any trade secrets, but may not classify the bid price or other specified evaluation-related figures as trade secrets. The bidder must disclose circumstances that may create a conflict of interest or distort competition and provide an explanation with the bid if such circumstances exist. The notice does not specify an award-scoring method.
