Compliance requirements
The bidder may be excluded for relevant final convictions within the previous five years involving the bidder or persons authorised to represent, manage or control it, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include breaches of tax or social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, suspension of business or comparable situations; serious professional misconduct; agreements intended to distort competition; unmanageable conflicts of interest; involvement in preparing the procurement where an advantage cannot otherwise be remedied; serious or repeated failures under previous contracts; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procurement. National grounds include enabling the unlawful employment of a foreign national, being subject to applicable international sanctions, and relevant tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must be legally entitled to conduct insurance activities in Estonia to the extent required to conclude mandatory healthcare provider liability insurance contracts under the applicable law. The contracting authority will check this in public registers, including the Financial Supervision Authority’s website. If the relevant information is not freely available there, the bidder must provide a licence, registration, competent authority certificate or other relevant evidence on request.
The bidder must ensure full service in Estonian for the policyholder and entitled persons, including claims handling until each case is resolved, and provide contact point details for contact points in Estonia. The bid must include a completed draft insurance policy consistent with the tender documents and containing no conditions. The premium must be entered in the structure specified in the pricing sheet and cover the entire insurance period; the insurance premium is exempt from VAT. The bid must be unconditional and confirm compliance with the tender documents. Where equivalence is relied on, the bidder must explain it and provide supporting evidence.
For a joint bid, the joint bidders must appoint an authorised representative and include the relevant power of attorney. The bidder must identify any trade secrets in the bid and justify that designation; the price and other specified evaluation-related numerical indicators may not be classified as trade secrets. The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers covered by the applicable EU sanctions restriction concerning Russian persons or entities.
The submitted documents do not specify the precise award criteria or their weighting; check the official tender documents for those details.
