Compliance requirements
The bidder must not be subject to mandatory exclusion grounds. These include relevant convictions of the bidder or its managers, supervisory-board members, procurists or other persons authorised to represent, decide for or control it for participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences involving the unlawful employment of foreign nationals or breaches of their employment conditions; and unlawful use of child labour or human trafficking. A bidder with outstanding national tax, duty or environmental-charge liabilities, or tax or social-security contribution debts under the law of its country of establishment, is also excluded.
The contracting authority may exclude a bidder for serious or repeated breach of a material term of a previous public contract where this led to termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder that provided false information about meeting qualification requirements or failed to provide required information or supplementary documents.
A bidder established in Russia or Belarus is not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must be worth EUR 40,000 or more, excluding VAT. The bidder must submit a list stating each contract’s performance period, the other contracting party’s details (including the customer representative’s telephone number and email address) and, for public contracts, the reference number. Evidence of proper performance must be provided on request unless the contracting authority can retrieve it from public or private databases without significant cost.
The bid must accept all tender-document conditions without additions or conditions. The bidder must submit a price table using the prescribed form and complete every unit-price field, taking account of the applicable V178 control-system document instructions.
Before bids are opened, the bidder must have entered in Elektrilevi’s partner portal (EPP) a person holding valid switching rights for the switching operations required by the works. For works limited to low voltage (0.22–1 kV), low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The relevant switching operations include operational switching, isolation and earthing, re-energisation and restoration of the normal configuration; the stated requirement excludes regional and distribution substations. The rights must be obtained in accordance with instruction J387.
The bidder must have a person appointed as responsible for the work operation (C-person), entered in the EPP before bids are opened. The rights must be obtained in accordance with documents J31 and J3284.
The bidder must have a person leading the electrical works who, by the bid submission deadline, holds valid A-class competence and/or a qualification of at least level 6 under the Vocational Qualifications Act, with evidence of the qualification, and who is entered in the EPP before bids are opened.
The bidder must provide the name, position and contact details of each contract signatory, the basis for their authority to represent the bidder, and the contact person for contract-performance matters. If representation authority does not arise from the articles of association, a power of attorney must be included.
The bidder must accept the applicable payment period: 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. If participating in the contracting authority’s factoring programme, the payment period is 95 calendar days from receipt of the invoice by the customer.
The bidder must identify and justify any information in the bid that it considers a trade secret. The bid price and component prices, as well as other figures or indicators used in evaluating bids, may not be classified as trade secrets.
The bidder must confirm that materials, equipment and goods, including components, installed or used in the works are neither produced in nor originating from Russia or Belarus. The contracting authority may request certificates of origin. No award criteria are specified in the supplied documents.
