Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder must be excluded if the bidder or a person authorised to represent, direct or control it has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorist offences or related participation, money laundering or terrorist financing; offences concerning the unlawful employment of foreign nationals or breaches of their employment conditions, including underpayment; or unlawful child labour or human trafficking. A bidder must also be excluded for outstanding state taxes, charges or environmental charges, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may exclude a bidder for a serious or persistent breach of an earlier public contract that resulted in termination, withdrawal, a price reduction, damages or a penalty, or for providing false information or failing to provide information or further documents requested to demonstrate compliance with qualification requirements. Companies established in the Russian Federation or Belarus may not participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the commencement of the procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must submit a list stating the performance period and the other contracting parties, including the customer representative’s telephone number and email address; for public contracts, include the reference number. On request, evidence of proper performance must be provided unless the contracting authority can obtain it from databases without significant expense. The work team must include a person with valid switching rights for the switching operations required by the works in the 0.22–20 kV network, excluding regional and distribution substations. This person must be registered in Elektrilevi’s partner portal before the tenders are opened. For works limited to low voltage (0.22–1 kV), at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). A person responsible for the work operation must also be registered in the portal before the tender submission deadline. The team must include a person leading the electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Professions Act, has the relevant evidence as of the tender submission date, and is registered in the portal before the deadline. The tender must comply with the procurement documents, and conditional tenders or tenders containing additional conditions are not allowed. The price must be submitted using the prescribed table, with every unit-price field completed, taking account of the instructions for management-system document V178. The bidder must provide the names, positions and contact details of the contract signatory or signatories and a contract-performance contact person; if the signatory’s authority does not arise from the articles of association, a power of attorney must be included. The bidder must also identify and justify any trade secrets, without treating the price or other legally non-confidential evaluation information as a trade secret. The contracting authority’s standard payment period, calculated from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. No precise award criteria are stated in the available documents; check the official tender documents.
