Compliance requirements
The bidder must be excluded if it, or a person authorised to represent, manage, control or make decisions for it, has been convicted of participation in a criminal organisation; breach of the duty of integrity or a corrupt act; fraud; a terrorist offence or related incitement, aiding or attempt; money laundering or terrorist financing; offences involving the unlawful employment of a foreign national or enabling breaches of the conditions for a foreign national’s employment in Estonia, including payment below the statutory minimum wage; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding state tax, duty or environmental charges, or tax or social security contribution debts under the law of its country of establishment.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached a material term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for damage or a contractual penalty; or that has provided false information about compliance with qualification requirements or failed to submit that information or requested supporting documents. Businesses established or resident in Russia or Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one of these contracts must have a value of EUR 40,000 or more, excluding VAT. The bidder must provide a list showing each contract’s performance period, the other contracting parties and their representatives’ contact details, including telephone number and email address, and the reference number for public contracts. The contracting authority may request evidence of proper performance unless it can obtain the information from public or private databases without significant cost.
The bidder must have a person authorised to perform the switching operations required for the works in the 0.22–20 kV electricity network, excluding regional and distribution substations. This person must be registered in Elektrilevi’s partner portal before tenders are opened. For works limited to low voltage (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). Training and authorisation must follow the specified switching-training procedure.
The bidder must have a person appointed to be responsible for the work operation, registered in the partner portal before tenders are opened. The bidder must also have a person leading the electrical works who holds valid A-level electrical competence and/or a qualification of at least level 6 under the Professions Act, has the relevant proof by the tender submission deadline, and is registered in the partner portal before tenders are opened.
The tender must be unconditional and comply with the procurement documents. The price must be submitted using the prescribed table, with every unit-price field completed, and must take account of the referenced V178 control-system document instructions. The bidder must identify and justify any information claimed as a trade secret; prices and evaluation-related figures may not be designated as trade secrets. The bidder must provide the contract signatory’s name, title and contact details, evidence of signing authority, and the contact person’s details for contract matters; if authority does not arise from the articles of association, a power of attorney must be included.
Standard payment periods, counted from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999; 35 days for contracts from EUR 60,000 to EUR 249,999; and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme entails a 95-calendar-day payment period.
The bidder must not be established or resident in Russia or Belarus. Materials, equipment, goods and components installed or used in performing the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
