The bidder must confirm that neither it nor its directors, managers, supervisory members, authorised representatives or persons exercising control has been finally convicted within the last five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. The bidder must also confirm that it has no outstanding tax or social security payment obligations. The applicable threshold is EUR 0; however, under Estonian tax rules, a tax debt certificate is generally not issued where the total debt administered by the tax authority is below EUR 100 or payment has been deferred. The bidder must not be in bankruptcy, liquidation, insolvency proceedings or a comparable situation, have suspended business activities, have seriously breached professional conduct rules, entered into agreements aimed at distorting competition, have an unmanageable conflict of interest, have participated improperly in preparing the procurement, or have seriously or repeatedly breached previous public contracts. The bidder must not have submitted false or misleading information, withheld required information, failed to provide requested documents, or sought confidential information improperly. It must also confirm compliance with Estonian exclusion grounds concerning illegal employment of foreign nationals, international sanctions and any applicable participation restrictions based on the bidder’s country of establishment. Where an exclusion ground exists, information on remedial measures may be provided if permitted by the applicable rules. First-tier subcontractors are checked during contract performance for the specified exclusion grounds, including fraud, money laundering or terrorist financing, child labour or human trafficking, participation in a criminal organisation, corruption, tax and social security arrears, international sanctions and illegal employment of foreign nationals.

The bidder’s net turnover from its entire business must have been at least EUR 240,000 in each of the last three completed financial years. If the financial year follows the calendar year, this means 2023, 2024 and 2025. The bidder must have completed at least one reconstruction of a building intended for public use during the 60 months preceding publication of the contract notice. The completed construction works must have covered at least 300 m² of net floor area. The bidder must provide the client’s name and contact details, a description of the contract, the contract performance period to month level and the net floor area. For a joint tender, the bidder must identify which works and what proportion were performed by each joint tenderer. The bidder must involve at least a two-person team in direct contract performance: a level 6 construction engineer or construction manager, or equivalent, and a level 7 diploma electrical engineer, or equivalent. The relevant persons must have sufficient Estonian-language skills to perform their duties. If translation is needed, the bidder must undertake to provide it at its own expense. The bidder must confirm the team’s qualifications and submit the persons’ details and supporting competence documents no later than before contract signature; if requested after submission, the information must be provided within three working days. The tender must include the completed pricing table in the required form, with all unit prices and totals shown both excluding and including VAT. Prices must be in euros, final and inclusive of all costs required to achieve the procurement objective. The bidder must accept the tender documents and contract conditions, keep the tender valid for three months from the tender submission deadline, and provide any required authorisation documents. A joint tender requires a representative’s power of attorney, a statement of joint and several liability and a separate tender passport for each joint tenderer. If the bidder relies on another undertaking’s resources, it must submit that undertaking’s signed commitment, describe the resources and their use, explain the undertaking’s role and provide its tender passport. Any claimed equivalence to specified standards, technical requirements or evidence must be explained and supported by appropriate proof. The bidder must also provide any required information about persons authorised to represent or control it who are not visible in the Estonian Commercial Register.
