Compliance requirements
The bidder may be excluded for relevant final convictions involving participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour and human trafficking. These grounds can also apply to members of the bidder’s management or supervisory bodies and persons authorised to represent, decide for or control the bidder. The notice refers to convictions within the preceding five years or an exclusion period that remains in force.
Other grounds include unpaid taxes or social-security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency or liquidation proceedings, creditor arrangements, administration of assets by a liquidator or court, or suspension of business; serious professional misconduct; agreements intended to distort competition; an unmitigable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be addressed; serious or persistent failures under previous contracts resulting in termination, damages, price reductions or penalties; false or misleading information, withholding information, failure to provide required documents, or improper attempts to influence the procurement or obtain confidential information. The grounds also include enabling unlawful employment of a foreign national, being subject to applicable international or Estonian sanctions, and any relevant local-tax arrears or restrictions on the right to participate set out in the tender documents. Where applicable, the bidder may provide evidence of remedial measures demonstrating restored reliability.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least one comparable training-services contract during the 36 months preceding the start of the procurement. Comparable work includes training on the Constitution of the Republic of Estonia, the Citizenship Act, Estonia’s system of government or other relevant legal topics. The bidder must provide a list of contracts with their values, dates, contracting parties and contact details, and the procurement reference number where available. The contracting authority may verify the information with the listed clients.
The delivery team must be maintained throughout the contract and include a project manager and at least two trainers; the project manager may not also act as a trainer.
- The project manager must have higher education, Estonian language proficiency of at least C1, and at least 24 months of project-management experience during the five years preceding the start of the procurement. Overlapping periods of experience are not counted twice.
- Each trainer must hold a qualification as a history and civics teacher or a higher-education qualification in law, political science, government studies or public administration; have Estonian language proficiency of at least C1; and have at least 24 months of adult-teaching experience during the ten years preceding the start of the procurement. Overlapping periods are not counted twice.
Submit the project manager’s and trainers’ CVs using the prescribed form, together with the required supporting documents. The project manager’s higher-education qualification must be evidenced by a copy of the relevant document, and a C1 examination certificate must be provided where necessary. Include name-change evidence where a name does not match and the document does not show an identity code. The relevant documents must be provided in a digital container signed by the person concerned. A second trainer’s CV and required documents must be supplied even if only one trainer is named in the schedule. Provide a contact person for participants’ questions.
The bid must accept the tender-document conditions and may not be conditional or include alternatives. Submit the required forms for the bid, service description and price, including the specified price structure. Where applicable, provide the bidder’s power of attorney or the digitally signed consortium members’ authorisation. Identify any claimed trade secrets and explain the grounds; the bid price and other numerical service-evaluation figures may not be designated as trade secrets. No award-scoring formula is stated in the provided documents.
