Compliance requirements
The bidder may be excluded if it or a member of its management, administrative or supervisory body, or a person authorised to represent or control it, has a relevant final conviction within the previous five years or is still subject to an exclusion period. The offences include participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and illegal use of child labour or other forms of human trafficking. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Exclusion may also apply for unpaid taxes or social security contributions, bankruptcy, an unresolvable conflict of interest, or involvement by the bidder or a related company in preparing the procurement where the resulting distortion of competition cannot otherwise be prevented. The bidder must also confirm that contracting with it would not violate an international or Estonian government sanction. For tax debts, the notice explains that the tax authority does not issue a debt certificate where the relevant debt is below EUR 100 or payment has been deferred; foreign bidders are assessed under the law of their country of establishment.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least one similar design assignment during the 36 months before the procurement began. The assignment must concern the design of a new external lift shaft for an existing non-residential building (use code 12000 or a subcode), with the shaft predominantly made of glass or metal and glass, and must include the lift and shaft designed for a lifting height of at least 12.0 metres. The work must have been performed under contract and in accordance with good practice. Provide a list of the relevant contracts, including their dates, the other contracting party and its representative’s contact details, and the procurement reference number where applicable. The contracting authority may verify the references with the clients.
The persons responsible for providing the service must include a level 7 certified construction engineer qualified to prepare building designs, a level 7 certified architect, and a level 7 electrical engineer with design competence or A-class competence (or an equivalent qualification), with design within the scope of competence. One person may fill multiple roles if they meet the qualifications for each. Equivalent qualifications are accepted. Provide each responsible person’s name, qualification and certificate number. Foreign bidders must provide equivalent qualification documents or other evidence of qualification under the law of their country of establishment. The authority may request copies of certificates and the individuals’ written consent to serve in the responsible roles.
The bid must accept the tender-document conditions; conditional bids are not permitted. Explain and provide evidence of equivalence where relevant. Submit the price in the specified structure and using the separate price table in Annex 3. For a joint bid, appoint an authorised representative and include the joint bidders’ power of attorney.
