Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder must confirm that neither it nor its relevant representatives have mandatory exclusion grounds, including final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking; allowing unlawful employment of foreign nationals or breaches of the conditions for their employment; unpaid taxes, duties or environmental charges, or unpaid social security contributions; or contract award that would breach international or Estonian government sanctions. The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; insolvency or comparable circumstances; serious professional misconduct; agreements or conduct that distort competition; an unmanageable conflict of interest or an unfair advantage arising from involvement in preparing the procurement; serious or repeated breaches of earlier public contracts; false or misleading information, failure to provide requested information, attempts to influence the contracting authority or obtain confidential information; tax-related criminal convictions; or lack of a legal right to submit a bid. Enterprises established in Russia or Belarus may not participate. The bidder must also confirm that it will not use Russian-linked subcontractors or suppliers for more than 10% of the contract value, and that the goods are not sanctioned or from a sanctioned territory.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 700,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts for those years showing net turnover, unless the information is publicly available to the contracting authority in a register. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years. At least six months must have elapsed since the end of the last completed financial year by the bid submission date. The bid must include the completed price table (Form 1), technical information in the medium-voltage switchgear questionnaire (Form 2), and the completed spare-equipment price table (Form 3). Partially completed required fields may result in rejection, and the quantities or line items in the price table must not be changed. A bidder offering both SF6 and SF6-free equipment must submit separate bids for them. From 1 January 2026, switchgear up to and including 24 kV using fluorinated greenhouse gases such as SF6 as the insulating or current-interrupting medium is subject to the stated EU restriction. If bids include SF6-free equipment from at least two manufacturers, only bids containing SF6-free equipment will be evaluated; bids containing SF6 equipment will be rejected. If only one manufacturer’s SF6-free equipment is offered, all bids will be assessed for compliance. The bidder must identify the contract signatory, provide the basis for their authority to sign, and name a contact person for contract-related matters. If signing authority does not arise from the articles of association, a power of attorney must be included. The bidder must disclose intended subcontractors using Form 4. The contracting authority checks first-tier subcontractors; subcontractors must not have mandatory exclusion grounds, and use of subcontractors with discretionary exclusion grounds requires prior written consent. The bidder must identify and justify any information in the bid claimed as a trade secret; bid prices and other specified evaluation-related figures may not be classified as trade secrets. Standard payment is within 45 calendar days after receipt of the invoice where the contract value is at least EUR 250,000. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must also confirm that the goods are not subject to international sanctions and do not originate from sanctioned territories, and comply with the stated restrictions on Russian-linked subcontractors and suppliers. No award criteria are specified in the provided documents.
