Compliance requirements
The bidder must have none of the exclusion grounds set out in § 95(1), points 1–5, and § 95(4), point 12, of the Estonian Public Procurement Act, and must confirm this. If people authorised to represent, make decisions for, or control the bidder are not identifiable from the commercial register, the bidder must provide their names and personal identification codes or confirm that there are no such people. A bid may also be rejected where awarding the contract would violate applicable international sanctions.
Qualification criteria and exclusion grounds
The bidder’s total net turnover from all business activities must be at least EUR 200,000 in each of the last three completed financial years. The bidder must provide turnover data for those years and, if requested because the information is not publicly available, the annual accounts or extracts for those years. If relying on another entity’s resources, the bidder must submit that entity’s consent in the prescribed form, specifying the turnover amount made available, confirming that it will provide financial resources if needed during contract performance, and accepting joint responsibility for proper performance. Where joint bidders rely on one another’s resources, the tender must describe the size and nature of the contract share to be performed by each. Foreign bidders or foreign participating entities must provide documents proving the required turnover. These turnover requirements apply to all lots and are not added together; the highest applicable turnover requirement takes precedence.
The bidder must have at least one sales outlet in Tallinn where the purchaser can buy goods, and must provide a list of outlets with their exact locations.
The bid must accept the procurement-document conditions and may not be conditional. Joint bidders must appoint an authorised representative and include the required power of attorney. The bidder must identify and justify any trade secrets, but may not classify the bid price or other specified evaluation-related figures as trade secrets. Where the bid proposes an equivalent product or solution, the bidder must explain the equivalence and provide supporting evidence. The bid price must follow the specified structure and include the completed Appendix 3 sample shopping basket price form. The exact award criteria are not set out in the available document text and should be checked in the official tender documents.
