Compliance requirements
The buyer will exclude a bidder if the bidder, or a person authorised to represent, manage or control it, has been convicted of offences involving participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism, money laundering or terrorist financing; offences relating to the unlawful employment of foreign nationals or breaches of their employment conditions; or unlawful child labour or human trafficking. Exclusion also applies where the bidder has outstanding state tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, or where awarding the contract would breach an international or Estonian government sanction.
The bidder must confirm that none of these grounds applies. A foreign bidder must provide a criminal-record extract or equivalent document from the country of establishment concerning the offences listed above, and a certificate from the competent authority confirming the absence of the relevant tax or contribution debts.
Qualification criteria and exclusion grounds
For Lots 1–3, the bidder must be registered in the commercial register or an equivalent register where required by the law of its country of establishment. The buyer will check the details of bidders registered in Estonia; a foreign bidder subject to a registration requirement must provide a current registration certificate.
For Lots 1–3, the bidder must hold accreditation from the Estonian Accreditation Centre for verification and/or calibration of measuring instruments and provide copies of the accreditation certificates. Subcontracting is permitted. If subcontractors are planned for these lots, the bidder must state the size and nature of the work to be subcontracted and provide the subcontractor details using Form 4.
The bid must be unconditional and confirm acceptance of all tender-document requirements. Prices must be entered in the structure specified in the evaluation worksheet, using the relevant price form for each lot (Forms 1, 2 and 3); all highlighted blank fields must be completed and no rows may be deleted. A consortium must appoint an authorised representative and include the consortium authorisation with its bid. The bidder must identify any information claimed as a trade secret and explain why; bid prices and evaluation-related numerical indicators may not be designated as trade secrets.
The bidder must disclose circumstances that may create a conflict of interest or distort competition, including involvement in preparing the procurement or a connection with the buyer that may have given it an advantage. If such circumstances exist, the bidder must provide an explanation identifying the person concerned, the nature of the connection and the information received or other relevant facts. The supplied text does not specify the precise award scoring method; check the official tender documents for the evaluation details.
