Compliance requirements

A bidder may be excluded if the bidder or a person in its management, supervisory or governing bodies, or an authorised representative, has a relevant conviction within the previous five years or remains subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking, and—in cases specified under national law—enabling unlawful employment of a foreign national or tax offences. Exclusion grounds also include failure to pay taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an analogous situation, an agreement with creditors, administration of assets by a liquidator or court, or suspension of business; serious professional misconduct; agreements intended to distort competition; an unresolvable conflict of interest; involvement in preparing the procurement that creates an unmitigable competitive advantage; serious or persistent failure under a previous contract resulting in early termination, damages or comparable sanctions; and providing false information, withholding required information or documents, or improperly seeking confidential information or influencing the procurement decision. A contract may not be awarded where doing so would breach international or Estonian sanctions. Where permitted by the applicable rules, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

For either lot, the bidder must have experience maintaining and repairing high-pressure compressors capable of delivering at least 330 bar. During the 36 calendar months preceding the start of the procurement, the bidder must have provided maintenance and repair services for high-pressure compressors to at least two different customers. The bidder initially provides information about this experience in the European Single Procurement Document; the contracting authority may verify the completed contracts with the successful bidder. The bidder must confirm that its tender complies with the procurement documents, including the draft framework agreement, is unconditional and remains valid for three calendar months from the tender submission deadline. Joint bidders must appoint an authorised representative and submit a power of attorney signed by all persons authorised to represent them; they are jointly and severally liable for performance of the framework agreement. The bidder must identify any trade secrets and explain why the information qualifies, but may not classify prices or other numerical data used for evaluation as trade secrets. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. It must undertake to carry out scheduled maintenance and emergency repairs in accordance with the technical specification, have the necessary tools, equipment and technical resources, and maintain at least one mobile service unit. The bidder must provide the address of its service location for repairs that cannot be performed at the compressor’s location. It must be able to install the manufacturer’s original spare parts and provide the manufacturer’s confirmation that it is an authorised representative in Estonia or can obtain and use the relevant parts from the manufacturer. Prices for scheduled maintenance of all the contracting authority’s compressors must be submitted for 2027 and 2028 using the form for the relevant lot. Prices must include all costs, including consumables and transport to compressor locations, and may not increase during the framework agreement. The total price, excluding VAT, for scheduled maintenance over the two years is an award criterion.
