Compliance requirements

The bidder must confirm that none of the exclusion grounds in § 95(1), points 1–3 and 5, of the Estonian Public Procurement Act, taking account of § 95(2), apply. The bidder must also confirm that it is not bankrupt, being liquidated, subject to bankruptcy or liquidation proceedings, or otherwise in a comparable situation under the law of its country of establishment, and that its business activities have not been suspended. The bidder must confirm that it has no outstanding national taxes, duties, environmental charges, or tax or social security contributions under the law of its country of establishment. The bidder must also confirm that, during the reference period, its employees’ average wages exceeded 70% of the average wage for the same period in the field relevant to the contract. The reference period is the six calendar months ending with the month two months before the calendar month in which the procurement was initiated. This wage level must be evidenced by an extract from the Estonian Tax and Customs Board or, for a foreign bidder, an equivalent competent authority in its country of establishment. Each member of a joint bid must provide evidence. The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment-building reconstruction. For a joint bid, each joint bidder is treated as a bidder. The beneficiary checks exclusion grounds for the successful bidder or, in a joint bid, all joint bidders.

Qualification criteria and exclusion grounds

The bidder must be registered in the Estonian Register of Economic Activities for construction, covering general construction, indoor climate systems, and building or associated water supply and sewerage systems. For electrical work, the bidder must also be registered for electrical installation construction, including installation. Foreign bidders may provide equivalent evidence of competence instead. The bidder’s net turnover in the financial year preceding the start of the procurement must be at least twice the estimated contract value, excluding VAT. In a joint bid, at least one member must meet this requirement individually; turnover may not be aggregated. The bidder must also confirm that, by the contract signing date or within 10 calendar days thereafter, it can provide a performance guarantee of 5% of the contract value. An acceptable guarantee may also be provided by depositing the amount in the beneficiary’s or a notary’s account, with the beneficiary entitled to it throughout the construction period. Joint bidders may provide the guarantee together. During the 60 months preceding the start of the procurement, the bidder must have completed at least one equivalent construction project as the main contractor, worth at least half the estimated contract value excluding VAT. The project must have involved construction, extension or full-building reconstruction and included structural and external envelope works, heat-recovery mechanical ventilation, and heating-system works. Completion must be evidenced by a handover and acceptance certificate signed by the client and contractor, or by a reference to the building register’s notice of use or occupancy permit. The team must include: - A project manager with at least a Level 6 building engineer qualification specialising in building construction and competence in managing construction activities, or a Level 6 construction manager qualification specialising in general construction. - A site manager with at least a Level 5 construction work manager qualification specialising in general construction. - A ventilation and heating systems specialist with at least a Level 6 heating, ventilation and cooling engineer qualification with the specified competencies in managing heating- and ventilation-system construction, or a Level 6 construction manager qualification specialising in indoor climate systems. - A water supply and sewerage systems specialist with at least a Level 6 water supply and sewerage engineer qualification with competence in managing construction activities, or a Level 6 construction manager qualification specialising in building or associated water supply and sewerage systems. - For electrical work, a person holding at least a Class B electrical competence certificate or a Level 6 electrical engineer qualification in consumer electrical installations. Equivalent qualifications are accepted for foreign bidders. The relevant specialists must participate in the works; provide their names and qualification or competence certificate numbers. The bidder must have construction-sector quality and environmental management systems meeting at least EVS-EN ISO 9001 and EVS-EN ISO 14001, respectively, or equivalent requirements. The bidder must submit the beneficiary’s pricing forms for both buildings, showing the costs included in the total price against the specified cost lines. The specified lines may not be changed, but additional lines may be added. The bid must accept all procurement-document conditions; conditional bids are not permitted. Joint bidders must submit an authorisation stating each member’s share and role in performing the contract; they are jointly and severally liable. The bid must be submitted by a statutory or authorised representative, with an authorisation document where required. Any trade secrets must be identified and the designation justified. Where an equivalent solution is offered, provide evidence of equivalence. For team members who are not employees of the bidder or joint bidders, provide each person’s written consent to participate in the team and perform the contract. No award criteria are specified in the provided documents.
