Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must be excluded if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; of enabling the unlawful employment of a foreign national or breaches concerning a foreign national’s employment conditions in Estonia, including payment below the statutory wage; or of unlawful use of child labour or human trafficking. Exclusion is also mandatory where the bidder has outstanding national tax, duty or environmental charge debt, or tax or social security contribution debt under the law of its country of establishment. The contracting authority may exclude a bidder that has seriously or persistently breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for damage or a contractual penalty. It may also exclude a bidder that has provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents. Participation is not permitted for companies established in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the contract subject during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 40,000 or more excluding VAT. The bidder must submit a list stating each contract’s performance period, the other contracting party’s details (including the client representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from public or private databases without significant expense. The bidder must have a suitably authorised employee for switching operations on the 0.22–20 kV electricity network, excluding regional and distribution substations. For work involving only low-voltage networks (0.22–1 kV), low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required, including when low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The employee must be registered in Elektrilevi’s partner portal before the bids are opened. The applicable training procedure is set out in document J387. The bidder must have a person appointed as responsible for the work operation and registered in Elektrilevi’s partner portal before the bid submission deadline. The bidder must also have an electrical work supervisor with valid A-level competence and/or a qualification corresponding to at least level 6 under the Vocational Qualifications Act. This person must hold the relevant evidence when the bid is submitted and be registered in the partner portal before the submission deadline. The bid must include a price table in the required format, with every unit-price field completed, and must take account of the completion instructions for management-system document V178. Conditional bids and bids containing additional conditions are not permitted. The bidder must provide the name, position and contact details of the person or persons authorised to sign the contract, as well as the name, position and contact details of the contract-performance contact. A power of attorney must be included if signing authority does not arise from the articles of association. The standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must state which option applies. The bidder must identify any information in its bid claimed as a trade secret and give reasons, or state that the bid contains no trade secrets. The bid price, component prices and other specified evaluation-related figures may not be designated as trade secrets. The bidder must be established outside the Russian Federation and Belarus. Materials, equipment, goods and components installed or used in carrying out the works must not be produced in or originate from either country; the contracting authority may request certificates of origin. No specific award criterion is stated in the provided documents.
