Exclusion is also mandatory where the bidder has outstanding national tax, duty or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may exclude a bidder that has seriously or repeatedly breached an essential term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has provided false information about meeting qualification requirements or failed to submit required information or additional documents. Entities established or resident in the Russian Federation or Belarus are not permitted to participate in the procurement.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of at least EUR 80,000 excluding VAT. The bidder must submit a list stating the performance period and information about the other contracting parties, including the customer representative’s telephone number and email address; for public contracts, include the procurement reference numbers. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder’s team must include: - A person authorised to carry out switching operations in the 0.22–20 kV electricity network, excluding regional and distribution substations, and listed in Elektrilevi’s partner portal before the tender opening. For low-voltage-only work (0.22–1 kV), low-voltage switching rights are required; otherwise both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. The relevant training rules must be followed. - A person appointed as responsible for work operations and listed in Elektrilevi’s partner portal before the tender submission deadline, with the applicable rights obtained in accordance with the stated safety and knowledge-assessment instructions. - A person leading the electrical works with a valid A-level competence and/or a qualification of at least level 6 under the Professional Qualifications Act, supported by evidence at the time of submission and listed in the partner portal before the deadline. The tender must be unconditional and comply with the procurement documents. The price must be submitted using the prescribed table, with every unit-price field completed, and the pricing must take account of the instructions for management-system document V178. The bidder must identify the contract signatory or signatories, their titles and contact details, and a contact person for contract-related matters. A power of attorney must be provided if signing authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and include their power of attorney. The standard payment period from receipt of the invoice is 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must identify any information claimed as a trade secret and explain why it qualifies; the price and other specified evaluation-related figures or indicators may not be designated as trade secrets. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from the Russian Federation or Belarus; the contracting authority may request certificates of origin. The notice specifies no award-scoring details.
