Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The buyer must exclude a bidder if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, professional misconduct, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to enabling illegal employment or violating the employment conditions of foreign nationals, including paying below the statutory wage; or illegal use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding state taxes, duties or environmental charges, or tax or social security contributions under the law of its country of establishment. The buyer may exclude a bidder for serious or repeated breaches of important terms of a previous public contract where this resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty. A bidder may also be excluded for providing false information about compliance with qualification requirements or failing to provide that information or requested supporting documents. Businesses established in the Russian Federation or Belarus are not permitted to participate.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have duly performed at least three contracts for electrical construction works similar to this contract. At least one contract must have been worth at least EUR 100,000 excluding VAT. The bidder must submit a list stating the performance periods, the clients’ representatives’ contact details (including telephone number and email address), and procurement reference numbers for public contracts. The buyer may request evidence of proper performance if the information cannot be obtained from databases without disproportionate effort. Before tenders are opened, the bidder must have an employee with valid switching authorisations registered in Elektrilevi’s partners’ portal. For low-voltage works only (0.22–1 kV), low-voltage switching authorisation is sufficient. In other cases, including where medium-voltage switching is needed to carry out low-voltage works, both low- and medium-voltage switching authorisations are required. Applications for authorisation must follow instruction J387. The bidder must also have a person responsible for the work operation registered in the portal; applications for that person’s rights must follow instructions J31 and J3284. The person leading the electrical works must hold valid A-level competence and/or a qualification of at least level 6 under the Professions Act, with the relevant evidence available by the tender submission deadline. The person must be registered in the partners’ portal before tenders are opened. The tender must include the price table using the form in the tender documents, with every unit-price field completed. Conditional tenders and tenders containing additional conditions are not allowed. By submitting a tender, the bidder confirms acceptance of the tender-document requirements. The bidder must provide the name, position and contact details of the contract signatory and the contact person for contract-related matters. If the signatory’s authority is not established by the articles of association, a power of attorney must be included. The bidder must also follow the completion guidance for management system document V178 when preparing its tender. The invoice payment period, counted from receipt by the buyer, depends on the contract value: 14 calendar days for contracts up to EUR 59,999; 35 calendar days for contracts from EUR 60,000 to EUR 249,999; and 45 calendar days for contracts of EUR 250,000 or more. Joining the buyer’s factoring programme extends the payment period to 95 calendar days. No award criteria are specified; check the tender documents if necessary. The bidder must identify and justify any information designated as a trade secret. The tender price and indicators relating to the award criteria may not be designated as trade secrets.
