Compliance requirements
The exclusion grounds cover final convictions within the past five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. They also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation or similar situations; suspended business activity; serious professional misconduct; agreements intended to distort competition; conflicts of interest or involvement in preparing the procurement where the resulting advantage cannot otherwise be addressed; serious or repeated failures under previous contracts; false or misleading information, withholding required information or documents, and attempts to improperly influence the procurement or obtain confidential information. National grounds include enabling a person staying in Estonia unlawfully to work, international or Estonian government sanctions, and convictions for tax offences. For tax debts, the notice states a threshold of EUR 0 and notes that a tax debt below EUR 100, excluding interest not established by an administrative act, or a debt whose payment has been rescheduled, does not result in the tax authority issuing a debt certificate. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability.
