Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder may be excluded for relevant final convictions involving the bidder or its representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, and for convictions concerning unlawful employment of foreign nationals or tax offences. Grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; agreements distorting competition; unresolved conflicts of interest or involvement in preparing the procurement where the resulting advantage cannot be addressed; and significant or repeated failures under previous public contracts, including early termination, damages or comparable penalties. Exclusion may also follow from false or misleading information, failure to provide required information or documents, attempts to improperly influence the procurement or obtain confidential information, and breaches of applicable environmental, social or labour obligations. The bidder must also declare that entering into the contract would not violate international or national sanctions. The notice records a zero-euro threshold for tax and social contribution arrears; it also notes that, under Estonian tax rules, a tax debt below EUR 100 or a debt whose payment has been rescheduled may not result in a tax-debt certificate being issued. Where permitted for the relevant ground and procedure, the bidder may provide evidence of remedial measures demonstrating restored reliability.

Qualification criteria and exclusion grounds

The bidder must provide a technical description of the proposed ultrasonic spray coating system addressing all technical conditions in the tender documents. The submission must include the product name, specifications, product sheets and any other information needed to verify compliance. If an equivalent solution is offered, the bidder must explain its equivalence and provide supporting evidence. The bid must comply with the tender documents; conditional bids are not permitted. The bidder must confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their direction. The bidder must also confirm that it is not domiciled or established in Russia or Belarus and that the goods offered are not subject to international sanctions and do not originate in a sanctioned territory. For a joint bid, the bidders must submit an authorisation appointing a representative for procurement-related actions and for concluding and performing the contract. The bid must identify any information claimed as a trade secret and explain that designation; the bid price and figures characterising the bid against the award criteria may not be designated as trade secrets. For exclusion checks, the bidder must provide the name and personal identification number or date of birth of any person authorised to represent, make decisions for or control the bidder who is not identifiable from the relevant register, or confirm that there are no such persons. The documents provided state no specific financial or prior-experience requirements and no award criteria.
